Lexecution of the death penalty for Lisa Montgomery has been suspended, according to the decision of a judge who recognized “a state of mind so altered” that the sentenced “cannot even understand the reason for her execution”. Montgomery, a 52-year-old US citizen, had been convicted of killing a pregnant woman 17 years ago opening her belly with a knife to steal her fetus. The lethal injection was scheduled for today January 12, and it would be there first woman to be executed by federal authorities in 70 years.
Montgomery is being held in a federal prison in the state of Indiana and her attorneys have argued that he is not in a state of mind “compatible” with the execution: suffers from mental disorders caused by rape and violence suffered from childhood. Judge James Hanlon, of the Southern District of Indiana, ordered that his execution be postponed. “The information submitted to the court contains ample evidence that Ms. Montgomery’s mental state is so far from reality that he cannot rationally understand the reason for his execution“, He wrote in his decision.
The same judge added that the court will set a date for one new hearing to assess his mental state. Montgomery was sentenced for facts dating back to 2004. That year, unable to have another child, he strangled a pregnant woman in Missouri and then opened her womb and abducted the fetus.
The last woman to be executed by the US government was Bonnie Heady, who died in a gas chamber in Missouri in 1953: together with her alcoholic and drug addict boyfriend, she had kidnapped and killed Bobbie Greenlease, her 6-year-old son and had at an old age by a wealthy Kansas City auto tycoon, another crime that left her America in shock.
