(ANSA) – ROME, 02 JAN – An American Court of Appeal has given the green light to the execution of Lisa Montgomery, the only woman currently on death row in the country: the application of the sentence is scheduled for January 12 .
The woman was given the death penalty for strangling a pregnant woman in 2004 and extracting the fetus from her body, which she then kidnapped.
According to international media reports, the execution was originally scheduled for last month, but was suspended after one of the woman’s lawyers fell ill with Covid. The Justice Department then set the new date for January 12, but Montgomery’s lawyers argued that the date could not be fixed while a stay of execution was in effect.
A judge in a minor court had therefore agreed with the defense, but yesterday three judges of the Washington DC Court of Appeals overturned his decision, giving the green light to the execution. The woman’s lawyers have already announced that they will file an appeal against their decision.
