Initially, Ms. Stokes and her family sought legal action against Leitrim County Council, claiming they were not properly classified as homeless despite severe mold issues in their previous residence. The family alleged the mold was so bad it led to hospital visits and forced them to sleep downstairs instead of in their bedrooms. While the council attempted to rectify the situation with ventilation improvements and mold removal, the family maintained these efforts were insufficient, arguing the property was unfit for habitation and emergency accommodation was necessary.
The family endured a five-year ordeal with the mold problem, eventually leaving the property temporarily to stay with relatives before returning. Despite placing the family on a transfer list, the council’s solution presented a new set of challenges.
“Objects Flying” in New Home
In October, the family moved into a new property. However, Ms. Stokes claims unsettling events began shortly after. She told Mr. Justice Garrett Simons, “Numerous objects” moved inexplicably, doors swung open, and furniture shifted, seemingly on its own. During one incident, objects flew out of a cupboard while she was preparing meals for her children.
“Everyone deserves a home. I never asked for a mansion, I asked for a safe home for my kids. I just want somewhere safe for my kids five days before Christmas,” Ms. Stokes pleaded.
Mr. Justice Simons acknowledged Ms. Stokes’ concerns and fears, but explained that securing a third property would require a new application to the local authority.
