Henderson, Nevada, to Sell BLM Land for Affordable Housing Development
The Bureau of Land Management (BLM) is proposing the direct sale of approximately 18.59 acres of public land in Henderson, Nevada, to support the development of the West Henderson Affordable Housing Apartments. The sale, authorized under the Southern Nevada Public Land Management Act (SNPLMA), aims to increase affordable housing options for low-income families in the region.
Details of the Proposed Sale
The parcel, identified as case file number NVNV106335451, is located within the Mount Diablo Meridian, Nevada, specifically in Section 16 and Section 17, T. 23 S., R. 61 E. (Federal Register). The proposed sale price is $1,859, based on a nominal disposal rate of $100 per acre established for affordable housing land disposals in fiscal year 2025 (Federal Register; BLM). A formal appraisal will be conducted to determine the parcel’s fair market value, despite the reduced sale price.
Affordable Housing Criteria
Under SNPLMA, “affordable housing” is defined as housing serving low-income families, those earning no more than 80 percent of the Area Median Income (AMI), as determined by the U.S. Department of Housing and Urban Development (HUD) (Federal Register). The City of Henderson’s nomination confirms that the proposed West Henderson Affordable Housing Apartments will dedicate 100 percent of the parcel to serve families earning 60 percent or less of the AMI, aligning with SNPLMA requirements (Federal Register).
Environmental Review and Public Input
The proposed sale is consistent with the BLM Las Vegas Resource Management Plan and has undergone environmental review through the Las Vegas Valley Disposal Boundary Environmental Impact Statement and the Las Vegas In-Valley Area Multi-Action Analysis Environmental Assessment (Federal Register). A parcel-specific Determination of National Environmental Policy Act (NEPA) Adequacy has also been completed. The BLM has determined the land is not needed for any federal purpose.
The public is invited to submit comments regarding the proposed sale. The BLM will accept comments for 60 days from the date of the official sale offer from the City of Henderson. The notice will also be published weekly for three consecutive weeks in the Las Vegas Review-Journal (Federal Register).
Terms and Conditions of the Sale
If the sale proceeds, the patent will include covenants and restrictions ensuring the land is used solely for affordable housing. A limited reversionary interest is also included, allowing the United States to reclaim the land if the affordable housing project is not authorized for occupancy within five years, unless an extension is granted (Federal Register). The land is subject to existing rights-of-way for utilities, roadways, and other infrastructure (Federal Register).
The City of Henderson has 30 calendar days from receiving the official sale offer to submit a formal written offer. Full payment must be received by the BLM Las Vegas Field Office within 30 calendar days of receiving the sale offer (Federal Register).
